The EU has agreed to Poland's demand for an exemption from EU rules setting high minimum excise tax rates on cigarettes, in order to prevent a sharp increase in tobacco prices in the country. The exemption will run until 2009.

EU continues lawsuit against cigarette producers despite dismissal by US court - 21 February 2002 - News

On Tuesday 19 February, a US district court dismissed the EU's claim that cigarette producers boost their profits by oversupplying Eastern European countries in order to favour smuggling into the EU, causing big tax losses. The European Commission announced it would continue its lawsuit against Phillip Morris, Japan Tobacco and R.J. Reynolds Nabisco, despite the dismissal of its claims.

Farm ministers divided over tobacco subsidies - 19 February 2002 - News

At the Agriculture Council meeting on 18 February 2002, the EU agriculture ministers held an orientation debate on the phasing out of subsidies to tobacco producers and on possible new tasks for the Community Tobacco Fund. During the meeting, wide divergences in opinion became apparent between the ministers from the tobacco-producing countries (Austria, Italy, France, Greece, Spain and Portugal) and the other member states.

The European Parliament approved, with amendments, the Commission's proposal on tobacco tax harmonisation. Internal Market Commissioner Bolkestein could not, however, accept the amendments, as he believes the Parliament's approach would "lead to less rather than more harmonisation of tobacco taxes".

MEPs want more money for new public health programme - 23 November 2001 - News

The Parliament's environment committee wants to increase the funding for the new Community action programme for public health (2001-2006). In its second reading on 20 November 2001, the EP committee went against the Council's common position and demanded an increase of the funding for this programme to 380 million euro.

The Commission has shelved proposals to introduce a ban on European-wide sales promotions of tobacco. The proposals, due to be published on 2 October, were scrapped over fears that they could lead to legal challenges from manufacturers and Member State governments. These fears were based on the existence of another Commission proposal for a ban on tobacco advertising that overlapped with the sales promotion ban.

British American Tobacco (BAT) and Imperial Tobacco announced that they plan to make a legal challenge to European Union legislation concerning packaging and sale of tobacco products. The two cigarette manufacturers are to file a legal action through the United Kingdom's High Court.

The European Commission has filed a new complaint against two US tobacco cigarette manufacturers on smuggling charges. Ten Member States, including Italy, Germany, France, Spain, Portugal and Greece, are participating in the new action.

A US District Court dismissed the Commission's civil action against Philip Morris and RJ Reynolds, which accused tobacco manufacturers of aiding in the smuggling of cigarettes into Europe. The Court ruled that the Commission could not show that their budget suffered any injury as a result of defendants' illegal acts.

Controversial cost/benefit study on smoking - 17 July 2001 - News

Premature deaths due to smoking have economic benefits according to a controversial report commissioned into the impact of smoking on Czech public finances by Philip Morris. The study found that the economic benefits of smokers' early mortalities, including the revenue from cigarette tax, outweighed the costs of healthcare, income tax loss and other smoking related costs.
