He says that the reference to the sports article in the new EU Constitution may be a tool in the future to regulate sport on a more solid legal platform, but the wording of the new article makes it indeed very doubtful how far EU may go to preserve the traditional European Model of Sport. ‘European Sports Law – A comparative analysis of the European and American Models of Sport’ (Forlaget Thomson, 2004), is a comprehensive comparative analysis of the most important legal issues that dominate professional European sport today. The book describes the present legal status of European sport in the post-Bosman era and analyses the possible legal consequences of the European Union’s strong political support of the unique mix of amateurism and professionalism in the European Model of Sport in a time of increasing commercialization where “the winner takes all” mentality seems to be prevailing.
