Modes of Regulation in the Governance of the European Union: Towards a Comprehensive Evaluation

Abstract

As part of its efforts to democratise European Governance as outlined in the EU Commission’s White Paper in 2000, the Commission is reconsidering its regulatory practices. The European Union is becoming a regulatory state with many faces and the Commission has indicated it wants to move increasingly away from classical top-down regulatory policy. These regulatory changes are intended to improve the quality of governing in the EU – both from an output (decision making, implementation, problem solving) and input (democratic quality) perspective.

The authors tackle the topic with a two-pronged approach, by first developing a typology of regulatory models employed in the EU and then examining the ongoing regulatory transition from a normative point of view, offering a critical commentary on regulatory modes and trends.
