US tobacco producer Philip Morris will fight an EU lawsuit on the alleged smuggling of cigarettes into the Union. In November, the European Commission decided to start legal proceedings against US tobacco giants Philip Morris and R J Reynolds for their alleged involvement in cigarette smuggling, resulting in huge losses in unpaid duty and VAT (see

EURACTIV 07 November 2000).

The American company filed papers with the European Court of First Instance, challenging the authority of the Commission to start the lawsuit.
